4. Account Registration

5. Subscriptions and Payment
5.1 Plans

5.2 Billing
- Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.
- All fees are exclusive of applicable taxes (including GST), which will be charged where required by law.
- Payments are processed through our third-party payment processors. By providing payment information, you authorize us to charge the applicable fees.
5.3 Renewals
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
5.4 Refunds
All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. If you believe you have been charged in error, please contact us within 30 days of the charge through our website.
5.5 Price Changes
We reserve the right to change pricing at any time. We will provide at least 30 days' advance notice of any price changes via email or in-app notification.

6. Acceptable Use
You agree to use PushBrigade only for lawful purposes and in accordance with these Terms. You must not:
- Send unsolicited, deceptive, or spam communications to any audience.

- Violate any applicable local, state, national, or international laws, including but not limited to the Information Technology Act, 2000 (India), the CAN-SPAM Act, GDPR, or any other applicable anti-spam or data protection legislation.
- Infringe upon the intellectual property rights of any third party.
- Upload or distribute malware, viruses, or any harmful or malicious code.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Use the Service to harass, abuse, threaten, discriminate against, or harm any individual or group.
- Impersonate any person or entity, or misrepresent your affiliation or identity.
- Use the Service to distribute content that is defamatory, obscene, unlawful, or otherwise objectionable.
- Engage in scraping, data mining, or unauthorized automated data collection from the Service.
- Resell or sublicense access to the Service without our prior written consent.
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these provisions.

7.1 Compliance
You are solely responsible for ensuring that all campaigns created and sent through PushBrigade comply with applicable laws and regulations, including anti-spam laws, data protection regulations, and the terms of service of any third-party social media platforms you connect to the Service.
7.2 Consent
You represent and warrant that you have obtained all necessary consents, permissions, and authorizations from your audience members to send them marketing communications via email or social media.
7.3 Unsubscribe and Opt-Out
All email campaigns sent through the Service must include a clear and functional unsubscribe mechanism. You must promptly honour all opt-out and unsubscribe requests in accordance with applicable law.
7.4 Content Responsibility
You are solely responsible for all content included in your campaigns, including images, text, links, and any other materials. We do not review or endorse campaign content but reserve the right to remove content or suspend accounts that violate these Terms or applicable law.
7.5 Third-Party Platforms
Connecting PushBrigade to third-party social media platforms (such as Meta, LinkedIn, X, etc.) is subject to the terms and policies of those platforms. We are not responsible for any changes to third-party platform APIs, policies, or availability that may affect the Service.

8. Audience Data
8.1 Ownership
You retain full ownership of your audience data, contact lists, and all related information ("Audience Data") that you upload or import into the Service.
8.2 License to Us
By using the Service, you grant ADEPTSTATION VENTURES PVT. LTD. a limited, non-exclusive, royalty-free license to store, process, and use your Audience Data solely for the purpose of providing the Service to you.
8.3 Your Responsibilities
You represent and warrant that:
- You have the legal right to collect, store, and use all Audience Data you upload to the Service.
- Your collection and use of Audience Data complies with all applicable privacy and data protection laws.
- You have obtained all necessary consents from individuals whose data you upload.
8.4 Data Retention

- THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR BUSINESS OBJECTIVES.
- CAMPAIGN DELIVERY RATES, OPEN RATES, OR OTHER PERFORMANCE METRICS WILL MEET ANY PARTICULAR STANDARD.
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
- ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADEPTSTATION VENTURES PVT. LTD., ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- LOSS OF PROFITS, DATA, GOODWILL, AUDIENCE, OR BUSINESS OPPORTUNITY.
- DAMAGES ARISING FROM CAMPAIGN PERFORMANCE, DELIVERY FAILURES, OR THIRD-PARTY PLATFORM CHANGES.
- DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

16. Termination
16.1 By You

We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to violation of these Terms. We will endeavor to provide reasonable notice where practicable.
16.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property, indemnification, disclaimers, and limitation of liability) shall remain in full force and effect.
